1. Acceptance of Terms

By registering an account or accessing MassivSend (accessible via www.massivsend.com), you agree to be bound by these Terms of Service and all applicable policies established by Meta Platforms, Inc. for the WhatsApp Business API.

2. Recipient List Responsibility & Anti-Spam Compliance

MassivSend provides software interfaces for executing promotional, transactional, and utility WhatsApp broadcasts using the Meta WhatsApp Cloud API. Users are subject to strict compliance guidelines:

• Contact List Authorization: You are solely responsible for ensuring that all contact phone numbers imported into your workspace comply with Meta's Business Messaging Policies and applicable data protection regulations.
• Automated Opt-Out Support: All promotional campaign templates sent via MassivSend should provide clear opt-out mechanisms (e.g., Quick Reply "STOP" or "Unsubscribe" buttons).
• Anti-Spam & Cold List Safeguards: Sending indiscriminate spam or aggressive cold broadcasts to unverified lists that result in high user block or report rates damages your Meta Phone Quality Health.

3. Prohibited Content & Business Categories

MassivSend strictly prohibits using our platform for broadcasting content that violates Meta's Commerce & Business Messaging Policy. Prohibited broadcasts include but are not limited to:

• Illegal goods, narcotics, prescription drugs, or weapons.
• Gambling, betting, lottery schemes, or predatory financial products.
• Adult, sexually explicit, or obscene media content.
• Phishing, deceptive financial claims, cryptocurrency scams, or impersonation.
• Hate speech, harassment, political propaganda, or unauthorized bulk data scraping.

4. Meta Number Health & Ban Disclaimer

MassivSend operates solely as a software technology layer interfacing with Meta WhatsApp Cloud API infrastructure. All messaging limits, template review decisions, quality rating penalties, phone number rate drops, and account restrictions are governed independently by Meta Platforms, Inc.

MassivSend is NOT liable or responsible for:

• Temporary or permanent WhatsApp phone number bans executed by Meta due to user spamming or high recipient block rates.
• Template rejections or delays by Meta's automated moderation algorithms.
• Global Meta server outages or API conversation rate changes.

5. Account Suspension & Abuse EnforcementNon-Refundable Abuse Enforcement

We maintain a zero-tolerance policy for platform abuse, spamming, or fraudulent activity. If your workspace account is flagged for illegal broadcasts or if Meta restricts your WABA account for policy violations:

• MassivSend reserves the right to immediately suspend or terminate your workspace access without prior notice.
• Accounts terminated due to policy violations, spamming, or abusive conduct will permanently forfeit all workspace access, connected services, and platform privileges.
• All subscription fees, plan charges, and unused messaging credits associated with accounts terminated due to policy abuse are strictly non-refundable.

6. Account Credentials & Security

You are responsible for maintaining the confidentiality of your workspace credentials, including Meta Cloud API Access Tokens, Phone IDs, and WABA IDs. MassivSend is not liable for unauthorized API calls or costs incurred due to compromised user credentials.

7. Disclaimer of Warranties

MassivSend is provided on an "as is" and "as available" basis without warranties of any kind. We do not guarantee uninterrupted uptime of third-party Meta infrastructure or external telecommunication networks.
